By the end of this module you will be able to understand:

  • Key concepts of liabilities and responsibilities in architecture
  • Role and responsibilities of architects in different procurement scenarios including traditional procurement and Design & Build contracts
  • Different ways architects can fulfill their responsibilities and liabilities, including: collateral warranty (beneficiaries); novation; and assignment
  • Potential conflicts of interest and parallel duties architects may face
  • Different types of liability and obligations, including: joint and several liability; civil liability; and the meaning of ”same damage”
  • Safety measures that can be taken to limit liability
  • Net contribution clauses

About this module

This course focuses on the roles and responsibilities of architects in terms of their liabilities and obligations. It covers the different contractual positions for architects, including traditional procurement, design and build scenarios, as well as various forms of liability, such as collateral warranties, novation, and third-party agreements.

Those enrolled will also learn about safety measures such as caps on liability, net contribution clauses and more.
